Samsung essential patents: the group reaches an agreement with the European Union

Since 2011, the European Union accuses Samsung abuse of essential patents. After lengthy discussions, the European authority has accepted proposals from Samsung. It will offer better access to patent licenses, but the EU can intervene in negotiations with other companies and oversee disagreements.

The mobile manufacturer Samsung is often at the heart of proceedings related to patents used. If the group is currently before the California court because Apple complains stolen patents, Samsung is trying, too, to defend its patents. A little too much according to the European Union inquiry into the practices of Samsung since 2011. End of 2012, the European authority had concluded that Samsung was abusing its dominant position by preventing Apple using patents deemed essential for smartphones. According to the European Union, it is impeding competition, punishable by a fine of up to 10% of annual turnover.
To avoid lawsuits, Samsung has begun discussions to find concessions

After several lists of proposals deemed unsatisfactory by the authorities and industry stakeholders, Samsung has sent new concessions in late 2013.
Studied so far, the EU has accepted proposals from Samsung.
The manufacturer shall undertake and to "provide fair and reasonable terms to potential licensees essential standards patents". The European Commission in charge of the sector can be involved in these negotiations.  

If Samsung and a third company did not reach an agreement within 12 months, the European authorities appoint a court or arbitrator to establish the agreement.
Also, Samsung will not file any injunction for a period of five years against European companies that have accepted the rules of concession licenses for essential patents. Samsung was pleased and said that it will "create greater transparency in the industry"
